Lawyers Battle Over Limits on Drug Marketers

Should pharmacies be able to sell a physician’s prescription records to a pharma marketer? Does the 1st Amendment protect a rep’s ability to market directly to doctors? Big questions being debated. David Savage in the Los Angeles Times:

Vermont’s doctors were surprised to learn their confidential prescription records were being sold. “They were completely unaware the drug marketers had access to their prescription records. They thought this compromised the physician-patient relationship, and that it was driving up the cost of pharmaceuticals,” Paul Harrington, executive vice president of the Vermont Medical Society, said in an interview.”,0,6588130.story
